Terms of Service

Choose your role to see the terms that apply to you

You are reading the User terms, for people who build and run AI agents on Aiyubot, buy from the Marketplace and hire experts.

User Agreement

These terms govern your access to aiyubot.com, its subdomains, the Aiyubot apps and the hosted Aiyubot platform (together, the Service). They are an agreement between you and Aiyubot about your rights and responsibilities. By creating an account, clicking a sign-up or sign-in button, or using the Service, you accept them and our Privacy Policy. We reserve all rights not expressly granted.

Please read the arbitration and class action waiver carefully. Unless you opt out within 30 days, most disputes with Aiyubot are resolved individually by binding arbitration, not by a jury or in a class action.

1. Using Aiyubot for an organisation

If you use the Service for a company or other organisation, these terms bind both you and the organisation, and you confirm you have authority to accept them for it. "You" then means both. The organisation is responsible for the acts of everyone using the Service on its behalf and for keeping the information it gives us accurate and up to date.

2. Eligibility

You may use the Service only if you are at least 18 years old (or older, where the law where you live requires it), can form a binding contract, and are not barred from the Service by law or by an earlier decision of ours to remove you.

3. Your account

  • You sign up with an email address and password, or with Google or GitHub. Email sign-ups are confirmed with a code sent to that address.
  • Each person may hold one account. One account can carry several roles (User, Expert and Publisher) and you can switch between them; the terms for the role you are acting in apply.
  • You are responsible for everything done through your account. Use a strong password, keep it to yourself, and tell us at once about any unauthorised use. You can turn on two-step sign-in in your settings. Several wrong passwords in a row lock the account for a short time.
  • Your account is personal to you and cannot be sold or transferred. We are not liable for losses caused by unauthorised use of your account.
  • We send service and legal notices to your account's email address and in the product. We may also send product news and offers, which you can unsubscribe from at any time; you will still receive service notices.

4. Your content

You (or your licensors) own the prompts, files, knowledge-base documents, instructions, messages and other material you put into the Service, and the output your agents produce from it (Your Content).

You grant Aiyubot a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display Your Content only as needed to provide, maintain, secure and improve the Service, to carry out the actions you and your agents ask for, to comply with the law, and as described in our Privacy Policy. Content your agents send through a channel is seen by the people and services on that channel.

You can delete Your Content in the product. Some copies may remain for a time, for example in backups, in the memory files your agents keep inside your workspace, or where the law requires us to keep them. We may remove or block access to content we believe breaks these terms.

You confirm you have all the rights and consents needed for Your Content and for how you and your agents use it, and that it does not break the law or infringe anyone's rights, including privacy and intellectual property. You are solely responsible for Your Content and its consequences.

5. Account information and usage data

We collect account information (such as your name, email address, billing details and support conversations) and usage data (such as logs, usage amounts and performance data). We may use them, including after your account closes, to operate and bill for the Service, provide support, keep the Service secure, investigate incidents, and analyse and improve the Service. Account information and usage data do not include Your Content.

6. Changes, suspension and closing your account

We may change the Service, add or remove features, plans or limits, and introduce usage limits. We may suspend or end your access, with or without notice, if you breach these terms, create risk or possible legal exposure for us or others, or do not pay what you owe. If you breach these terms, the remaining terms continue to bind you.

You can stop using the Service at any time, and cancel paid plans as described in the Plans, Credits & Billing Terms. To have your account closed and its data deleted, contact support@aiyubot.com. If we close your account for breach, you may not open another one.

7. Trials, previews and experimental features

Some features are offered as trials, previews or experiments — for example channels marked "Experimental" or "Coming soon". They may contain bugs, are provided "as is" without any warranty, support commitment or liability, may change or never become generally available, and may be withdrawn at any time, which can make related content unavailable. Information about unreleased features is confidential.

8. Aiyubot's intellectual property

The Service and everything in it other than Your Content and other members' content — including its software, design, models of operation, text, logos and trademarks — belongs to Aiyubot or its licensors and is protected by intellectual-property laws. A patent has been applied for and the platform is protected under CNIPA, the IPOPHIL Bureau of Patents, the USPTO and WIPO PCT filings. You may not copy, sell, license, rent, modify, distribute, reverse engineer, or create works that imitate or approximate the concept or function of the Service, except as these terms expressly allow.

If you send us feedback or suggestions, we may use them freely, without any obligation to you, and they become ours.

9. Privacy

Our Privacy Policy explains how we collect, use and share personal data, the cookies we use, and your choices. Your data may be processed in countries other than your own. Where you put other people's personal data into the Service, you are responsible for having a lawful basis to do so.

10. Security

We use technical and organisational measures to protect Your Content, including encryption of the API keys you save. No system is perfectly secure, and we cannot guarantee that unauthorised people will never defeat those measures. You provide Your Content at your own risk and should keep your own copies of anything important.

11. Support chat and other interactive features

The Service includes an AI support assistant and other chat features. We, and the providers that power them, may monitor and keep transcripts of those conversations to answer you and to check and improve quality.

12. Publicity

If you use the Service for a business, we may name that business as a customer in our marketing. We will stop promptly if you ask us at support@aiyubot.com.

13. Indemnity

You will defend, indemnify and hold harmless Aiyubot, its affiliates, suppliers and licensors, and their personnel, from any claim, loss, liability or expense (including reasonable legal fees) arising from: your use of the Service; what your agents do and send; your breach of these terms; your breach of anyone's rights, including privacy and intellectual property; your breach of the law; Your Content; your wilful misconduct; or anyone's use of the Service with your credentials.

14. No warranty

The Service and all output are provided "as is" and "as available", and you use them at your own risk. To the fullest extent the law allows, Aiyubot disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service or any output will be accurate, reliable or correct, will meet your needs, will always be available, uninterrupted or secure, or that defects will be fixed.

No professional advice. Nothing in the Service, including anything an agent produces, is financial, investment, legal, tax, medical or other professional advice. Projections, analyses and recommendations generated by AI are for information only; get qualified advice before relying on them.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

15. Limitation of liability

To the fullest extent the law allows, Aiyubot and its affiliates, suppliers and licensors are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, goodwill, use or data, arising from the Service; or for unauthorised access to your account or data, interruptions, bugs or harmful code introduced by third parties, errors in content or output, or the conduct of any third party.

Our total liability for all claims relating to the Service or these terms is limited to the fees you paid Aiyubot in the 12 months before the event giving rise to the claim. This limit is cumulative, not per claim, and applies whatever the legal theory, even if we were told the damage was possible. Some jurisdictions do not allow these limits, so they may not apply to you.

16. Confidentiality

Either of us may share non-public business, product or technical information with the other, including information about preview features (Confidential Information). It does not include information that is public through no fault of the recipient, was already known to the recipient, was received lawfully from someone else, or was developed independently.

The recipient will protect Confidential Information with at least reasonable care, use it only for the purposes of these terms, and share it only with people who need it and are bound by similar duties. If the law compels disclosure, the recipient will give notice where it lawfully can. Because a breach could cause irreparable harm, the discloser may seek an injunction without proving damages.

17. Informal resolution first

Before starting any formal proceeding, the party with a complaint must send the other a written notice describing the dispute and the outcome it wants. Notices to Aiyubot go to support@aiyubot.com with the subject line "Legal notice". The other party should reply within 30 days, and both will try in good faith to settle the dispute for 60 days after the notice. Time limits for bringing a claim are paused during that period.

18. Arbitration and class action waiver

To the extent the law where you live allows it, a dispute that is not settled informally will be resolved by binding arbitration before a single arbitrator, in English, on an individual basis, and not in court. Either party may instead bring an individual claim in a small-claims court that has jurisdiction, and either party may ask a court for urgent injunctive relief to protect intellectual property, confidential information or the security of the Service, or to recover unpaid amounts.

Disputes are brought individually. Neither you nor Aiyubot may bring or join a claim as a plaintiff or class member in a class, collective or representative proceeding, and an arbitrator may not consolidate the claims of different people. If this waiver is found unenforceable for a particular claim, that claim alone goes to court and the rest stay in arbitration.

You may opt out of arbitration within 30 days of first accepting these terms by emailing support@aiyubot.com from your account's email address with your name and a clear statement that you opt out. Opting out does not change any other part of these terms.

19. Governing law

These terms are governed by the laws of the place where Aiyubot's operating company is established, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you are a consumer, nothing in this section takes away the protection of mandatory laws of the country where you live.

20. Changes to these terms and to the Service

We may update these terms. The "Last updated" date at the top of this page shows when they last changed. For changes that materially reduce your rights, we give you reasonable notice before they take effect, by email or in the product. Continuing to use the Service after a change takes effect means you accept it; if you do not, stop using the Service and close your account.

We may add, change or remove features, or suspend or discontinue all or part of the Service, including to reflect how features are used, keep the Service sustainable, or respond to changes in the cost of the AI infrastructure it runs on.

21. General

  • Entire agreement. These terms, together with the documents they refer to, are the whole agreement between you and Aiyubot about their subject, and replace earlier versions. If a translation conflicts with the English text, the English text controls.
  • Assignment. You may not transfer these terms or your account without our written consent. We may transfer them, for example as part of a merger or sale of the business.
  • Severability and waiver. If a provision is found unenforceable, the rest stays in force. Not enforcing a provision is not a waiver of it.
  • Relationship. Nothing in these terms creates a partnership, joint venture, employment or agency relationship between you and Aiyubot, or between you and any other member.
  • Force majeure. Neither party is liable for a delay or failure caused by events outside its reasonable control, such as outages of infrastructure or third-party providers, natural disasters, war or government action.
  • Sanctions and export control. You confirm you are not the subject of trade or economic sanctions and will not use the Service in breach of export control or sanctions laws, or make it available to anyone who is barred from it.
  • Electronic communications. You agree to receive notices electronically, by email to your account address or in the product, and that electronic records and acceptances have the same effect as signed paper ones.
  • Contact. Questions about these terms: support@aiyubot.com. Privacy questions: privacy@aiyubot.com.
